In response to a series of allegations of scientific misconduct in the 1980’s, a number of scientific societies, national agencies, and academic institutions, including Harvard Medical School, devised guidelines to increase awareness of optimal scientific practices and to attempt to prevent as many episodes of misconduct as possible. The chief argument for adopting guidelines is to promote good science. There is no evidence that well-crafted guidelines have had any detrimental effect on creativity since they focus on design of research studies, (...) documentation of research findings, assignment of credit through authorship, data management and supervision of trainees, not on the origin and evolution of ideas. This paper addresses a spectrum of causes of scientific misconduct or unacceptable scientific behavior and couples these with estimates of the potential for prevention if guidelines for scientific investigation are adopted. The conclusion is that clear and understandable guidelines should help to reduce the chance that flawed research will escape from our institutions. However, they cannot be relied upon alone to prevent all instances of scientific misconduct and should be regarded rather as one means of bolstering the integrity of the entire scientific enterprise. ABSTRACT. This paper considers two sets ethical obligations owed by a firm and its management to stockholders and employees with respect to layoffs. Literature and research from ethics and agency are used to frame ethical issues that pertain to age discrimination in layoffs. An actual court case provides an example for focus, analysis, and discussion. Points of discussion include management''s obligations to employees and factors of injustice related to prejudice against age.

We investigate the relationship of the degrees of splittings of a computably enumerable set and the degree of the set. We prove that there is a high computably enumerable set whose only proper splittings are low 2.

Smiles provide information about a social partner’s affect and intentions during social interaction. Although always encountered within a specific situation, the influence of contextual information on smile evaluation has not been widely investigated. Moreover, little is known about the reciprocal effect of smiles on evaluations of their accompanying situations. In this research, we assessed how different smile types and situational contexts affected participants’ social evaluations. In Study 1, 85 participants rated reward, affiliation, and dominance smiles embedded within either enjoyable, polite, (...) or negative (unpleasant) situations. Context had a strong effect on smile ratings, such that smiles in enjoyable situations were rated as more genuine and joyful, as well as indicating less superiority than those in negative situations. In Study 2, 200 participants evaluated the situations that these smiles were perceived within (rather than the smiles themselves). Although situations paired with reward (vs. affiliation) smiles tended to be rated more positively, this effect was absent for negative situations. Ultimately, the findings point toward a reciprocal relationship between smiles and contexts, whereby the face influences evaluations of the situation and vice versa. (shrink)

The key to wealth in health care is the physician, who certifies to third-party payers that health care items and services are necessary for patient care. To compete more effectively for this wealth, physician specialists are organizing their practices into for-profit corporations and employing other physicians. Focusing on neonatology, this article describes the prevailing business model of these for-profit medical groups as controlling employed physicians through restrictive employment contract provisions, e.g., non-compete and mandatory arbitration clauses. With this business model and (...) because of deficiencies in current law, for-profit medical groups eliminate competition from other physician specialists to the detriment of patients and consumers. The second combines highness with a modified version of the proof strategy of Cooper et al. . The third theorem is a rather surprising result with a somewhat unusual proof strategy. Its proof is a 0‴ argument that at times moves left in the tree so that the accessible nodes are not linearly ordered at each stage. Thus the construction lacks a true path in the usual sense. Two substitute notions fill this role: The true nodes are the leftmost ones accessible infinitely often; the semitrue nodes are the leftmost ones such that there are infinitely many stages at which some extension is accessible. To each computable enumerable (c.e.) set A with a particular enumeration {As}s∈ω, there is associated a settling function mA(x), where mA(x) is the last stage when a number less than or equal to x was enumerated into A. One c.e. set A is settling time dominated by another set B (B >st A) if for every computable function f, for all but finitely many x, mB(x) > f(m₄(x)). This settling-time ordering, which is a natural extension to an ordering of the (...) idea of domination, was first introduced by Nabutovsky and Weinberger in [3] and Soare [6]. They desired a sequence of sets descending in this relationship to give results in differential geometry. In this paper we examine properties of the <st ordering. We show that it is not invariant under computable isomorphism, that any countable partial ordering embeds into it, that there are maximal and minimal sets, and that two c.e. sets need not have an inf or sup in the ordering. We also examine a related ordering, the strong settling-time ordering where we require for all computable f and g, for almost all x, mB(x) > f(mA(g(x))). (shrink)

This article identifies a papyrus in Warsaw, P.Vars. 6, as a fragment of the large Latin–Greek glossary known as Ps.-Philoxenus. That glossary, published in volume II of G. Goetz's Corpus Glossariorum Latinorum on the basis of a ninth-century manuscript, is by far the most important of the bilingual glossaries surviving from antiquity, being derived from lost works of Roman scholarship and preserving valuable information about rare and archaic Latin words. It has long been considered a product of the sixth century (...) a.d., but the papyrus dates to c.200, and internal evidence indicates that the glossary itself must be substantially older than that copy. The Ps.-Philoxenus glossary is therefore not a creation of Late Antiquity but of the Early Empire or perhaps even the Republic. Large bilingual glossaries in alphabetical order must have existed far earlier than has hitherto been believed. (shrink)

Truth's asymmetry is illustrated by the following fact: while we accept that is true because Eleanor is drowsy, we do not accept that Eleanor is drowsy because is true. This asymmetry requires an explanation, but it has been alleged, notably by David Liggins, that the minimalist about truth cannot provide one. This paper counteracts this pessimism by arguing that the minimalist can successfully explain the asymmetry conceptually, rather than metaphysically. David Hume, Adam Smith, Jeremy Bentham and John Stuart Mill are often viewed as contributors to or participants in a common tradition of thought roughly characterized as ‘the liberal tradition’ or the tradition of ‘bourgeois ideology’. This view, however useful it may be for polemical or proselytizing purposes, is in some important respects historiographically unsound. This is not to deny the importance of asking what twentieth-century liberals or conservatives might find in the works of, say, David Hume to support their (...) respective ideological persuasions. It is only to insist that attempts to use selected arguments, or parts of arguments, from great eighteenth-century thinkers to shore up twentieth-century programmatic political positions must be categorically distinguished from attempts to understand what Hume, Smith, Bentham or Mill actually meant, or could imaginably have meant, to say. Hirschfeldt and Shore have introduced a notion of stability for infinite posets. We define an arguably more natural notion called weak stability, and we study the existence of infinite computable or low chains or antichains, and of infinite $\Pi _1^0 $ chains and antichains, in infinite computable stable and weakly stable posets. For example, we extend a result of Hirschfeldt and Shore to show that every infinite computable weakly stable poset contains either an infinite low chain or an (...) infinite computable antichain. Our hardest result is that there is an infinite computable weakly stable poset with no infinite $\Pi _1^0 $ chains or antichains. On the other hand, it is easily seen that every infinite computable stable poset contains an infinite computable chain or an infinite $\Pi _1^0 $ antichain. In Reverse Mathematics, we show that SCAC, the principle that every infinite stable poset contains an infinite chain or antichain, is equivalent over RCA₀ to WSCAC, the corresponding principle for weakly stable posets. In their logical analysis of theorems about disjoint rays in graphs, Barnes, Shore, and the author (hereafter BGS) introduced a weak choice scheme in second-order arithmetic, called the $\Sigma ^1_1$ axiom of finite choice (hereafter finite choice). This is a special case of the $\Sigma ^1_1$ axiom of choice ( $\Sigma ^1_1\text {-}\mathsf {AC}_0$ ) introduced by Kreisel. BGS showed that $\Sigma ^1_1\text {-}\mathsf {AC}_0$ suffices for proving many of the aforementioned theorems in graph theory. While it is not (...) known if these implications reverse, BGS also showed that those theorems imply finite choice (in some cases, with additional induction assumptions). This motivated us to study the proof-theoretic strength of finite choice. Using a variant of Steel forcing with tagged trees, we show that finite choice is not provable from the $\Delta ^1_1$ -comprehension scheme (even over $\omega $ -models). We also show that finite choice is a consequence of the arithmetic Bolzano–Weierstrass theorem (introduced by Friedman and studied by Conidis), assuming $\Sigma ^1_1$ -induction. Our results were used by BGS to show that several theorems in graph theory cannot be proved using $\Delta ^1_1$ -comprehension. Our results also strengthen results of Conidis. (shrink)

We give a partial answer to an important open problem in descriptive set theory, the Decomposability Conjecture for Borel functions on an analytic subset of a Polish space to a separable metrizable space. Our techniques employ deep results from effective descriptive set theory and recursion theory. In fact it is essential to extend several prominent results in recursion theory (e.g. the Shore-Slaman Join Theorem) to the setting of Polish spaces. As a by-product we give both positive and negative results (...) on the Martin Conjecture on the degree preserving Borel functions between Polish spaces. Additionally we prove results about the transfinite version as well as the computable version of the Decomposability Conjecture. (shrink)

Prospective memory is required for many aspects of everyday cognition, its breakdown may be as debilitating as impairments in retrospective memory, and yet, the former has received relatively little attention by memory researchers. This article outlines a strategy for changing the fortunes of prospective memory, for guiding new research to shore up the claim that prospective memory is a distinct aspect of cognition, and to obtain evidence for clear performance dissociations between prospective memory and other memory functions. We begin (...) by identifying the unique requirements of prospective memory tasks and by dividing memory's prospective functions into subdomains that are analogous to divisions in retrospective memory (e.g., short- versus long-term memory). We focus on one prospective function, called prospective memory proper; we define this function in the spirit of James (1890) as requiring that we are aware of a plan, of which meanwhile we have not been thinking, with the additional consciousness that we made the plan earlier. The participants included both those who have had extensive experience in the dialogue, as (...) well as a number of new voices. The conference both critiqued previous and ongoing efforts at dialogue and also took the dialogue itself in new directions. While Buddhist-Christian dialogue of the past has often focused on comparative doctrine, involving theological issues and comparative beliefs, this conference focused instead on comparative practice, an approach that was quite productive. The practices explored included monasticism, pilgrimage, bowing, meditation, renunciation, social action and—of particular relevance to the overall project of interfaith encounter—the practice of dialogue itself and the methods and virtues necessary to carry it out successfully.Comparative PracticeIn the first of three panels, the following questions were central: Despite the differences that exist in metaphysics, doctrine, and worldview between the traditions, are there certain practices which, because they are shared, point to some deep commonalities between the traditions? The observation of our thoughts, desires, and passions [is] a universal experience.”David Komito, a fellow at the Center for the Pacific Rim and scholar of Tibetan Buddhism, in his talk “Teacher, Reliquary, Circumambulation,” discussed the practice of pilgrimage in the Vajrayana Buddhist tradition of Tibet. The questions that framed his talk included, “What would be the virtue of visiting a stupa (reliquary) and what would be the goal of travel?” He pointed out that the answer to such questions would depend on one’s philosophical or theological position, explaining that the different schools of Buddhism would often provide different answers. Yet their experiences might be very different; in fact, pilgrims on the same journey who arrive at a sacred site may even be seeing different things while looking at one and the same object. This is because they might be framing, interpreting, and understanding the experience differently. If this is true among Buddhists, how much more so between Buddhists and Christians?The panel continued with Father Paul Bernadicou’s “Catholic Guides to Buddhist Practice.” Father Bernadicou, the chair of the Department of Theology and Religious Studies at USF, discussed a number of Catholics who have had deep encounters with Buddhism and incorporated Buddhist practice and insights into their own spiritual path. Aspects of Reason. New York: Oxford University Press, 2001. Pp. xxxviii + 136. Cloth, $29.95. H. P. Grice made it clear in some of his best works that he was a friend of reason. In "Logic and Conversation," he suggested that it was plausible that the general principles regulating (...) conversation are instantiations of principles of reason. His friendship with reason is central to Aspects of Reason, a revision of the John Locke Lectures given at Harvard. Unfortunately, not far into reading Aspects of Reason, Wittgenstein's quip, "A philosophical problem has the form: 'I don't know my way about'" (Philosophical Investigations, paragraph 123) came to mind and it did not leave me for the rest of the book. (See Grice's own admission on page 4.)As best I can tell, Grice has two main goals. The first is to show that theoretical (or alethic) reasoning and practical reasoning are at bottom the same. Aristotle and Kant held the same thing, as Grice notes more than once. Pace many philosophers who hold that 'ought' does not mean the same thing in the sentences 'She ought to repay the loan' and 'He ought to be home by this time,' Grice holds that it does. That is, the practical 'ought' and the alethic 'ought' have the same sense or senses. While the thesis is clear enough, Grice's path to proving it is not sufficiently clear. He claims that the same general sense of 'rational acceptability' is involved in each sentence. This claim is not informative because the idea of acceptability is no clearer than the claim roughly that 'ought' has the same sense in both its alethic and practical uses. (The editor Richard Warner recognizes this, and tries to shore up Grice's view; see xvi-xvii.)The second of Grice's main goals is to prove that modals in both alethic and practical sentences are conditional. In effect, sentences that say something ought to be the case or ought to be done are conditioned on some premises from which the sentence is or may be logically derived. (Nonetheless, he thinks some sentences with modals are a priori and underived.)There are too many promissory and subjunctive gestures like this: "I suspect that such a reply could be constructed, but I do not have it at my fingertips (or tongue-tip), so I shall not try to produce it." And too many prepositional phrases, under the shared command of abstract nouns and verbs in the passive voice, march single file through the pages, e.g.: "a brief consideration of what modifications might be required or convenient for the employment of mode-markers in the representation of the content of thought (or acceptance)" (70). Some of the few substantive results seem to me to be prolix: Let us suppose it to be a fundamental psychological law that, ceteris paribus, for a creature x (of a sufficiently developed kind), no matter what A and B are, if x wills A and judges that if A, A only as a result of B, then x wills B. This I take to be a proper representation of "he who wills the end, wills the indispensable means"; and in calling it a fundamental law I mean that it is the law, or one of the laws, from which 'willing'... In (Fund Math 60:175–186 1967), Wolk proved that every well partial order (wpo) has a maximal chain; that is a chain of maximal order type. (Note that all chains in a wpo are well-ordered.) We prove that such maximal chain cannot be found computably, not even hyperarithmetically: No hyperarithmetic set can compute maximal chains in all computable wpos. However, we prove that almost every set, in the sense of category, can compute maximal chains in all computable wpos. Wolk’s original result (...) actually shows that every wpo has a strongly maximal chain, which we define below. We show that a set computes strongly maximal chains in all computable wpo if and only if it computes all hyperarithmetic sets. (shrink)

At the intersection of meta-ethics and philosophy of science, Nicholas Sturgeon’s “Moral Explanation” ([1985] 1988), Richard Boyd’s “How to be a Moral Realist” (1988), and David Brink’s Moral Realism and the Foundations of Ethics (1989) inaugurated a sustained argument for the claim that moral kinds like right action and virtuous agent are scientifically investigable natural kinds. The corresponding position is called “non-reductive ethical naturalism,” or “NEN.” Ethical nonnaturalists, by contrast, argue that moral kinds are genuine and objective, but not natural. (...) This dissertation is largely a challenge to non-reductive ethical naturalism from the viewpoint of ethical nonnaturalism. An introduction, four fairly independent chapters, and a conclusion comprise this dissertation. The introduction (chapter one) situates and summarizes the arguments in the four chapters that immediately follow, and the concluding chapter (chapter six) describes future work related to the arguments in this dissertation. I now turn to chapters two through five. In chapter two, I shore up what I believe are weakness in Derek Parfit’s Triviality Objection to reductive ethical naturalism and then present a challenge to the NEN theorist, which, I argue, the NEN theorist must but ultimately cannot meet. The challenge is to sketch an empirical experiment whereby we can adjudicate between competing moral hypotheses. I explain in terms of experimental design and evaluation why the challenge cannot be met. Chapters three and four focus on the semantics and reference relations of kind terms. In chapter three, I defend the Causal Externalist (CE) theory of semantics and reference against an objection distilled from two articles by Åsa Marie Wikforss. The objection is that CE implies a paradox, escape from which forces the CE theorist upon the horns of a dilemma. I show how the CE theorist can avoid the dilemma by allowing that the intensions of some artificial-kind terms (e.g., ‘jade’) are not given by descriptions associated with the terms. One consequence of this move, however, is that it casts doubt upon the coherence of the claim that moral-kind terms (e.g., ‘morally required action’) are natural-kind terms. In chapter four, I defend Terence Horgan and Mark Timmons’s Moral-Twin Earth argument from three critical responses put forward in recent paper by David Merli. NEN theorists claim that CE can account for the semantics and reference of moral-kind terms. As per Horgan and Timmons (H&T), however, our responses to the Moral-Twin Earth thought experiment give us reason to doubt the NEN theorists’ claim. Against H&T’s argument, however, Merli presents three independent, critical responses, and in this chapter I defend H&T’s argument in a way that is friendly to the ethical nonnaturalist. One upshot is, I contend, that the ethical nonnaturalist can and indeed should co-opt H&T’s argument for his own use. In chapter five, I return to kinds themselves, specifically those in biology. I first point out that ethical nonnaturalism appeals to a metaphysical thesis about nonnatural value, which need not be limited to the moral domain. Then, I argue that biological naturalism alone cannot give a satisfying realist account of biological kinds like HEART and NEURON. Finally, I show that by conjoining the concept of Cummins functions as recently defended by Paul Davies, a thesis about nonnatural value, and Ned Block’s Disney Principle regarding structural properties, the nonnaturalist, unlike the naturalist, can offer a satisfying realist account of biological kinds.
